Kalsi Legal Aid · Appeals · Fresh claims

Fresh asylum claims on legal aid.

Fresh claims built on what is new, tested against the rules before anything is sent.

Why it matters

Before you start

Sending the same story again does not work. Further submissions that add nothing new are refused, often with no right of appeal.

Who this is for

Is this you?

  • Your asylum claim and any appeal have been refused and your appeal rights have ended.
  • Something has changed: events in your country, your health, your family, or new documents.
  • You have been told you must leave, and you believe you still cannot go back safely.
What we do

How we help

We start with your whole history: the refusal, the appeal decision and what the judge found. Then we look hard at what is new. If it is new and significant enough, we build the further submissions (fresh claim) around it, with the evidence to prove it, and send them to the Home Office in the way it currently requires. If it is not enough yet, we tell you plainly and what would make the difference.

Step by step

What happens

  1. Send us your papers: the refusal letters and appeal decisions you have.
  2. We review what is new against the earlier findings.
  3. Our advice in writing: whether a fresh claim can succeed, and whether legal aid covers it.
  4. Evidence gathered and submissions sent.
  5. The Home Office decides whether this is a fresh claim. If it accepts it and refuses, you get a new right of appeal.
Before you contact us

What to bring

Every Home Office letter and Tribunal decision you have, and the new evidence. If you do not have your old papers, tell us who your last lawyer was.

Legal aid

Is it covered by legal aid?

Fresh asylum claims are asylum work and can be covered, subject to the money test and our assessment of the merits. Who qualifies

Timing

How long it takes

We give you our view in writing once we have your papers; the Home Office then sets its own pace.

Your caseworker

Who handles your case

One named, Law Society accredited caseworker runs your case from the first meeting to the decision, supervised by a senior accredited supervisor. We arrange qualified interpreters. Tell us your language and dialect.

On legal aid cases, we will never ask you for money. What you tell us stays confidential; we never share your story without your consent, except where the law requires it.

Questions

Common questions

What counts as new?

Something that was not considered before and, taken with the old evidence, could change the result. A different way of telling the same story is not enough.

Can I be removed while a fresh claim is waiting?

It depends on your situation. If you have removal directions or are detained, tell us at once.

My old lawyer has my file. What do I do?

Tell us who they were. With your permission we ask for it.

“Things change: your country, your health, your evidence. When something new and significant comes to light, the door can open again.”
